General Terms

These Terms of Use ("Terms") govern your ("User/You") use of the Gearz Vehicle rental service ("Service") operated by QDHIR Techologies (OPC) Pvt. Ltd., including its affiliates, subsidiaries, and licensees ("Gearz/We/Us").

By using the Service, you agree to be bound by these Terms, as updated periodically. If you do not agree to these Terms, you must refrain from booking, renting, or using any Gearz Vehicle ("Vehicle(s)") or Service. These Terms constitute a legal agreement between you and Gearz, requiring careful review before availing of the Service.

1. Account Creation and Eligibility

To access the Service, you must create an account by providing accurate, complete, and up-to-date information, including your name, email, address, and date of birth. Users must be 18 years or older. You must not impersonate another individual or provide false or misleading information.

2. Reservations, Payments, and Cancellations

  • Booking and Payment: All reservations must be made in advance, and the full rental fee ("Rental Fee") is payable at the time of booking as outlined in the Fee Policy.
  • Cancellations: Cancellations must be made at least one day prior to the booking date to avoid charges. Same-day cancellations are subject to penalties under the Fee Policy.
  • Extensions: Reservation extensions are subject to vehicle availability and must be requested before the current reservation expires. Approval of such extensions is at Gearz's sole discretion.

3. Documentation Requirements

At the time of vehicle pickup, users must provide:

  • Driving License: A valid original license for riding motorcycles, retained securely during the rental period and returned upon return of the vehicle.
  • Residential Address Proof: A government-issued ID (e.g., Aadhaar, Passport, or Voter ID) for verification purposes. Private company IDs are not accepted.
  • Local Address Proof: Outstation users must present proof of local stay, such as a hotel bill, rental agreement, or PG receipt.
  • Company ID or Business ID Proof: For users representing a company or business, a valid company-issued ID or business registration document may be submitted.

4. Vehicle Usage and Conduct

The user agrees to operate the Vehicle responsibly and in accordance with all applicable laws, including the Motor Vehicles Act, 1988. Prohibited activities include racing, stunts, overloading, commercial use, and intoxication. Users are liable for fines arising from traffic violations.

5. Pickup, Return, and Vehicle Condition

Gearz reserves the right to modify the allocated vehicle based on operational needs. Vehicles must be returned in the same condition as they were at pickup. Users are responsible for costs arising from damages or delayed returns.

6. Incidents and Vehicle Breakdowns

Gearz maintains its fleet to high standards, but unforeseen breakdowns may occur. Users must inform Gearz immediately in such cases. Gearz will arrange for a mechanic or replacement vehicle. In case of accidents, users must file a police report and provide necessary details.

7. Penalties and Liability for Breach

Any violation of these Terms may result in penalties as defined in the Fee Policy or criminal proceedings for breaches with legal consequences. Users are responsible for damages to Gearz's property or reputation arising from such violations.

8. Termination of Service

Gearz reserves the right to terminate your access to the Service in case of violations of these Terms, with or without prior notice. Sections meant to survive termination (e.g., indemnification) will remain in effect.

9. Governing Law and Disputes

These Terms are governed by the laws of India. The courts of Bangalore shall have exclusive jurisdiction over disputes arising under these Terms.

10. Intoxication Policy

Users found intoxicated during pickup or return may have their booking canceled without refund. Repeat offenses may lead to a permanent ban from the Service.

11. Cross-State Travel

Users are responsible for covering state entry taxes and obtaining the necessary permits. Gearless scooters are prohibited from inter-city or interstate travel, with violations incurring a ₹300 penalty upon return.

12. Miscellaneous Provisions

Severability: If any provision is deemed invalid, the remaining terms will remain enforceable.

Gearz Vehicle is not liable for any misuse of credit or debit card information, whether online or offline, caused by the User’s negligence or error.
